1. Acceptance of Terms

By creating an account and using The Shade Library, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. The Service

The Shade Library provides a professional colour matching and client management platform for hairdressers and colourists. We reserve the right to modify, suspend or discontinue any part of the service at any time with reasonable notice.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and up to date
• Notifying us immediately of any unauthorised use of your account

4. Subscription and Payment

The Shade Library operates on a subscription basis. By subscribing you agree to:

• Pay the applicable subscription fee for your region
• Automatic renewal of your subscription at the end of each billing period
• Our refund policy — subscriptions are non-refundable except where required by law

All payments are processed securely by Lemon Squeezy. We do not store your payment details.

5. Free Trial

New accounts receive a 30 day free trial with full access to all features. At the end of the trial period your account will require an active subscription to continue accessing the platform. We reserve the right to modify or discontinue the free trial offer at any time.

6. Your Data

You retain full ownership of all client data and colour formulas you enter into the platform. By using the service you grant us a limited licence to store and process this data solely for the purpose of providing the service to you.

You are responsible for ensuring that any client data you enter complies with applicable data protection laws in your jurisdiction, including obtaining appropriate consent from your clients where required.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the platform
• Share your account credentials with others
• Reverse engineer or attempt to extract the source code of the platform
• Use automated tools to scrape or extract data from the platform

8. Intellectual Property

The Shade Library, including its design, code, content and shade database, is our intellectual property. You may not copy, reproduce or distribute any part of the platform without our express written permission.

The shade data within the platform is compiled from publicly available brand information and our own research. Individual brand names and shade names remain the property of their respective owners.

9. Limitation of Liability

The Shade Library is provided as a reference tool for professional use. We do not guarantee the accuracy of shade matching results and are not liable for any outcomes resulting from colour formulas used based on information from the platform. Always apply your professional judgement when working with colour products.

To the maximum extent permitted by law, our total liability to you for any claims arising from use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your subscription at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these terms.

Upon termination you may request an export of your data within 30 days. After that period we may delete your data permanently.

11. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by email. Continued use of the platform after changes constitutes acceptance of the updated terms.
